Terms of Business - Personal Lines

Our service to you

We act as an Independent Broker on your behalf. Because of our wide range of providers we are able to discuss your needs and establish a product best suited to you. We do not charge for any quotations, advice given or credit/debit card payments.

Your duty to us

We will ask for and seek all relevant information from you in order to recommend an appropriate policy. You must supply us with the requested information, as failure to do so, or to provide incorrect information may lead to you buying an inadequate product or worse, the insurer may not pay the claim. Insurers request all “material facts” to be disclosed, which may be described as any fact, if known, which may be likely to influence their decision to accept a risk and on what terms. If any information supplied changes during of the course of the policy period, you must notify us immediately as this may influence the cover and policy terms and conditions.

Confidentiality / Data Protection Act

We will treat all customers’ personal information in a confidential manner and we will ask a series of questions to ensure that we are speaking to our customer and not a person who is not authorised to ask questions or to give instructions to us.

We can only take instructions to effect or to alter a policy from the Policyholder or their legal representative.

Your data is held in compliance with the legislative requirements.

Usage and Storage of Your Personal Information

The data you provide will be kept confidential and is collected and processed for the following general purposes or for any other legitimate purpose described by the application of law:

  • To process your quotation or provide requested services
  • To fulfil requests for products or services
  • To improve our products or services
  • In order to contact you about products, services or promotions offered by us and/or other carefully selected partners unless you have asked us not to do so. This includes contact in any way including mail, email, telephone, text, or multimedia messages. You can opt-in or opt-out of receiving such information at any time by contacting us.

Our Quotation to You

All premiums quoted are inclusive of HM Government Insurance Premium Tax (IPT). We reserve the right to withdraw or amend any premium indications before they are taken up.

We offer Motor Legal Expenses Cover through Accident Support Group Limited and Kinderton Accident Management.

Breakdown & Recovery Services are provided by Europ Assistance via Marsh Brokers Ltd and Auto Legal Protection Services (ALPS Ltd).

Guaranteed Car Hire is arranged through Nice 1 Limited.

Travel Insurance is arranged via Voyager Insurance Services.

Evidence of No Claims bonus/ Club membership / Limited Mileage In consideration of being granted temporary insurance cover under a policy without providing us with evidence of no claims bonus, club membership, you undertake to provide such evidence within fourteen days of the commencement date. This also applies to policies where you have selected to limit your annual mileage.

If you do not provide suitable evidence you must pay such increased premium having withdrawn the discount originally allowed. In the event that the policy has to be cancelled as a result of your failure to provide acceptable proof and you failing to pay any increased premium, you will be asked to pay a time on risk charge based on the total gross premium together with our cancellation fee.

Cancellation

You have certain rights of cancellation in the early stages of the policy life and these are shown in the insurer’s policy document. However we are entitled to retain our commission and fees as they are deemed earned upon the inception of your instructions. Policies vary between insurers and are otherwise calculated on a short period scale weighted in favour of the insurers. and are otherwise calculated on a short period scale weighted in favour of the insurers, as their costs are similar whether a policy has run for one day or for one year. Cancellation cannot occur until we are in receipt of your current insurance certificate and written instructions to cancel your policy. Cancellation refunds are not given if there have been any losses or accidents which may result in a claim during the period of insurance.

If you are paying via a finance agreement / direct debit arrangement, cancelling the direct debit mandate does not cancel the policy.

Ownership There is no ownership between any insurer and us.

Premiums received

We hold your premium paid to us as agent of the insurer.

Our charges / Return premiums

We receive our income from insurers who pay us commission for arranging your insurance. In addition to this charge of £20.00 for arranging the policy at inception, renewal, setting up a finance agreement and for duplicate documents. A charge of £25.00 is applied for all mid-term or temporary adjustments. All charges are in addition to the insurers premium and, if applicable, insurers charges are non-refundable.

If you are entitled to a return premium under your policy, we will deduct our charges from the insurer's refund and retain our commission as we must repay our commission to your insurer on any return premium issued.renew or cancel an insurance policy. If you are entitled to a return premium under your policy, we will deduct our charges from the insurer's refund, as outlined above. We must repay commission to your insurer on any return premium issued. Our refund to you will be subject to the deduction of our charges and commission.

Please note that any net premium below £25.00 will be held as a credit on your policy record against any future adjustment or renewal.

If you are paying via a finance agreement/direct debit, your net return premium will be returned to your finance provider. A charge of up to £20 may be made in the event of a default, failure to pay, late payment or recorded delivery letters. This charge may be made each and every time this occurs. Charges are also non-refundable.

Instalments

If your payment is arranged by instalments a credit agreement is issued. Your attention is drawn to the terms and conditions of the agreement as charges are made for interest and administration. If you cancel your policy during the term of the credit agreement you may be liable to pay any outstanding balance not covered by your payments. Please also note that we cannot refund any instalment charges applied by us or a third party credit arranger. In the event of a claim being made against your policy, any outstanding balance becomes immediately payable.

Tacit renewals

In the event that your policy is by paid by direct debit or a credit agreement, we will notify you prior to the renewal date of the premium and terms and conditions that will apply. Unless we hear from you on, or prior, to the renewal date your policy will automatically be renewed.

Complaints procedure

Should you have any cause to complain, please contact us in the first instance in order that the situation may be resolved to your satisfaction.

In the event that we are unable to resolve your complaint, we will send an acknowledgment within five working days advising you of the person who will be investigating the circumstances. In the event that it still remains outstanding after a further 28 days, we will write to you again advising you of the reasons for the delay and giving a timescale in which you will hear from us again.

Should you wish to take the matter further you may refer your complaint to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London E14 9SR.

Financial Services Compensation Scheme

We are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of insurance and circumstances of the claim. Insurance advising and arranging is covered for 100% of the first £2000 and 90% of the remainder of the claim without any upper limit, for those products where insurance is compulsory. Non-compulsory products are covered on a flat 90% basis. Further information about the compensation scheme arrangements is available from the FSCS.

Law

This agreement shall be governed by the Laws of England & Wales and the parties agree herewith that any dispute arising out of it shall be subject to the exclusive jurisdiction of the relevant Court.
